A comparison of different societies shows that the cultural patterns of rationality differ considerably. Basic ideas within cultures are relevant to the significance of norms of rationality within a society. Decisive is the basic mode of orientation towards the empirical world. Two contradicting views on the status of rationality in primitive societies are contested. One view holds that – due to scarce technological means in the struggle for survival – early cultures are a kind of prototype of the rational homo (...) economicus. Levy-BruhlLevy-Bruhl, Lucien argued the exact opposite and described primitive thinking as having a pre-logical nature. In his view, they may be characterized as having an undifferentiated irrationality. Both claims are empirically untenable. Studies by MalinowskiMalinowski, Bronislaw and FirthFirth, Raymond have shown that even the simplest societies have many non-economic elements, such as, religious rituals, but also rational and practical technologies.In comparing primitive and advanced societies, it is argued that there is not a naturalistic increase of rationality, but that the status of rational action depends on ideas. One famous point of reference is Max WeberWeber, Max’s thesis of the Protestant ethic as an important source for the development of modern rational economies. For modern society, it was not only Protestantism, but also a “climate of opinion,” for which the emergence of philosophical rationalism and the ideas of natural law and natural order are characteristic examples. Coral bleaching has impacted reefs worldwide and the predictions of near‐annual bleaching from over two decades ago have now been realized. While technology currently provides the means to predict large‐scale bleaching, predicting reef‐scale and within‐reef patterns in real‐time for all reef users is limited. In 2020, heat stress across the Great Barrier Reef underpinned the region's third bleaching event in 5 years. Here we review the heterogeneous emergence of bleaching across Heron Island reef habitats and discuss the oceanographic drivers that (...) underpinned variable bleaching emergence. We do so as a case study to highlight how reef end‐user groups who engage with coral reefs in different ways require targeted guidance for how, and when, to alter their use of coral reefs in response to bleaching events. Our case study of coral bleaching emergence demonstrates how within‐reef scale nowcasting of coral bleaching could aid the development of accessible and equitable bleaching response strategies on coral reefs. Publikation der Grundlegung zur Metaphysik der Sitten untersucht, orientiert sich an der in Abschnitt II der Schrift von 1785 vorgenommenen Einteilung aller Imperative in problematische, assertorische und apodiktische. Da diese Einteilung in besonderem Maße geeignet ist, "die Architektonik von Kants praktischer Philosophie insgesamt zu erhellen" (S. 19), wird man durch den behutsamen Nachvollzug ihrer Ausdifferenzierung erwarten dürfen, neue Einsichten in die Entwicklung von Kants Denken zu gewinnen. Damit ist für den Interpreten keine leichte Aufgabe gestellt. Ohne philologische Umsicht, breite Kenntnis der zeitgenössischen Literatur, des Kantischen Oeuvres und der internationalen Sekundärliteratur sowie ein Gespür für Fragen der Datierung und Gewichtung von Kants Reflexionen und den studentischen Nachschriften seiner Vorlesungen, ist ein derartiges Unterfangen von vornherein zum Scheitern verurteilt. Schwaiger verfügt über diese Fähigkeiten und Kenntnisse.Nach einer informativen Einleitung, in der Stellung bezogen wird zum Stand der Forschung, der Kantischen Dreigliederung der Praxis als dem Leitfaden der Untersuchung, zur Methodik und den erzielten Ergebnissen, wendet sich Schwaiger in Teil I zunächst Kants moralphilosophischen Texten bis einschließlich 1770 zu. Mit Blick auf die 1762 verfasste und 1764 publizierte Untersuchung über die Deutlichkeit der Grundsätze der natürlichen Theologie und der Moral weist Schwaiger den entscheidenden Einfluss von Alexander Gottlieb Baumgarten (vgl. S. 43) auf Kant nach, wohingegen seiner Einschätzung nach die Bedeutung von Crusius in der Literatur bei weitem überschätzt worden ist. Der moralphilosophische Ansatz von Baumgarten ist vor allem auch deshalb für Kant so wichtig, weil dieser Ansatz am Begriff der Verbindlichkeit ausgerichtet ist (vgl. S. 50). Kant übernimmt von Baumgarten den von diesem bereits verbindlichkeitstheoretisch gedeuteten Terminus des Imperativs, nicht ohne jedoch darauf hinzuweisen, dass Baumgartens moralische Grundregeln tautologisch sind (vgl. S. 59 f.).Die Ausdifferenzierung des Baumgartenschen Praxisbegriffs in Kants ´Bemerkungen´ in den Beobachtungen über das Gefühl des Schönen und Erhabenen ist nach Schwaiger als eine genuin Kantische Leistung anzusehen, auf die Rousseau, wie einige Autoren meinten, keinen Einfluss gehabt hat. Die Inauguraldissertation von 1770 gibt schließlich Kants Gedanken einer Metaphysik der Sitten einen neuen Gehalt. Schwaiger vertritt gegenüber Josef Schmucker und Dieter Henrich die wohlbegründete These, dass Kants Ethik nicht schon um 1765 in ihren wesentlichen Grundzügen vorliegt. Erst nach der [End Page 443] "´platonischen Revolution´" (S. 25) von 1770 sind die Voraussetzungen für den Weg zur Grundlegung geschaffen, erst nach 1770 verwendet Kant beispielsweise den Terminus ´Imperativ´. Hätte Kant bereits in der Mitte der sechziger Jahre eine Metaphysik der Sitten publiziert, wäre der Anteil der empirischen Moral sicherlich sehr umfangreich gewesen (vgl. S. 80).Auch die in Teil II vorgelegten Resultate sprechen für eine allmähliche Ausbildung der kritischen Ethik, die nicht geradlinig verlaufen ist. Die 1770er Jahre sind nach Schwaiger durch Kants Bemühen gekennzeichnet, die im Bereich der Logik gewonnene Unterscheidung zwischen problematischen, assertorischen und apodiktischen Urteilen auch auf praktische Sätze anzuwenden. Des weiteren findet sich erst in den siebziger Jahren, nach Kants Wende zur reinen Moralphilosophie, die Unterscheidung zwischen einem Dijudikations- und einem Exekutionsprinzip (vgl. S. 91 ff.).Schwaigers Studie zeigt eindrucksvoll, dass quellengestützte begriffsgeschichtliche Untersuchungen für die Erforschung der Entwicklungsgeschichte der Kantischen praktischen Philosophie unverzichtbar sind. O estudo em questão tem por objetivo analisar a Lei 9099/95, que instituiu os Juizados Especiais Cíveis na Justiça Estadual, no que diz respeito aos seus limites e potencialidades discutidos a partir da principiologia proposta pela citada Lei em um viés jurídico-filosófico. Observar-se-á para tanto a Teoria do Discurso enquanto arcabouço procedimental capaz de potencializar a observância na prática de uma justiça mais célere, simples, informal, econômica e baseada na oralidade. Para tanto aplicar-se-á a interpretação do pensamento de Jürgen Habermas (...) e de Robert Alexy em conjunto a autores tradicionais do Direito com o objetivo de se avaliar se o pensamento dogmático se encontra superado ou ainda se apresenta como um entrave para que os princípios, que a Lei atribui a condição de Critérios Orientadores dos Juizados Especial Cíveis, sejam observados na realidade fática. The financial Crunch of 2008 was easily explained by both the left and right–too easily. Each insisted that events thoroughly confirmed its own long-held views and utterly refuted those of the opposed camp. This essay argues that there are indeed new lessons to be drawn from the Crunch, lessons that involve balancing the bounty of the Invisible Hand against perils of the Prisoner's Dilemma. Liberal moral imperatives are traced to variables of Personal Choice and External Cost that are typically in (...) tension with each other and thus generate needs for institutional reconstructions that change according to time and circumstance. Personal bankruptcy protection, limited liability corporations, and intellectual property are cited as examples. It is argued that the Crunch occurred because of failure adequately to balance these variables. Three paradoxes came to a head in 2008: Paradox of Efficient Markets; Paradox of Reduced Risk; Paradox of Hard-won Knowledge. The essay concludes with suggestions concerning specific lessons to be drawn from the Crunch and a corresponding list of lessons not to be drawn. (shrink)

I was recently asked to report on editorial trends in the Hastings Center Report, past and future. What I reported is that HCR has been going in two seemingly contrasting directions. One has to do with moral decision‐making in clinical ethics—the core theme in bioethics for fifty years, but still developing. A second editorial trend is treatment of larger social and political issues that bear on health, such as public health interventions and access to health care. I could also have (...) noted a continuing stream of pieces on emerging technologies, from whole‐genome screening for newborns to artificial intelligence in clinical diagnoses to the so‐called de‐extinction of extinct animals and plants through various genetic and reproductive tricks. This January‐February 2019 issue of HCR reflects all these trends. (shrink)

Il presente studio si pone in ideale continuità con l’opera di Marcello Gigante Nomos Basileus, analisi fondamentale della nascita e delle interrelazioni tra diritto naturale, diritto divino e diritto positivo nel mondo greco, prendendo le mosse proprio dal punto in cui questi aveva interrotto la sua indagine, ossia sulle concezioni platoniche del nomos e le sue connessioni con il divino, l’anima e l’educazione. In Platone sono rintracciate le premesse teoretiche della concezione, poi diffusa in età ellenistica, imperiale e tardo-antica, e (...) solitamente attribuita agli stoici, del sovrano come nomos empsychos legge incarnata, fonte del diritto positivo in quanto è legge esso stesso. In Platone esiste uno stretto rapporto tra diritto naturale, diritto divino e diritto positivo: che il nomos empsychos sia espressione della legge di natura risulta dal principio platonico secondo cui natura è per l’uomo l’anima e principalmente la dimensione intellegibile e divina che è in essa. I governanti degni promulgano leggi positive che scaturiscono dalla loro anima divina: così può essere garantito il fondamento divino e naturale delle leggi positive. -/- . (shrink)
